Terms & Conditions – Brandify Web Design
Brandify Web Design is a division of Brandify. When entering into a business relationship, YOU will enter into a contractual relationship with Brandify Web Design, where YOU will be referred to as “The Client.” It is your responsibility to read and understand all terms and conditions posted on this website. By using this website, you agree to be bound by these Terms of Use, regardless of whether you have read them.
The Client will also enter into a written contract with Brandify Web Design. This contract will outline all project details, and the Client agrees to comply with all applicable legal terms and conditions related to the leasing, purchasing, and/or use of Brandify’s Customized Website Subscription Services.
Confidential Policy
Brandify Web Design acknowledges that a material part of the Agreement is to keep all confidential information belonging to both parties strictly confidential during and after the term of this agreement. The Client agrees to follow and respect this confidentiality policy in the same manner.
All information shared by Brandify Web Design—including pricing, project strategies, project management details, design concepts, and related materials—shall not be disclosed to any third party without prior written consent from Brandify Web Design.
Services Policy
Brandify Web Design will create a customized website (“Website”) for the Client as part of its Customized Website Subscription Services, subject to the selected package and signed agreement. The Client understands that certain design elements or functions may also be used in other Brandify-designed websites, excluding Client-provided content such as text, images, and logos.
All materials created by Brandify Web Design are copyrighted exclusively to Brandify Web Design. These materials may not be copied, reused, altered, or distributed outside the agreed scope. Ownership of all intellectual property, including code and design assets, remains with Brandify Web Design. The Client is granted a non-exclusive, revocable license to use the work while the account remains active and in good standing.
Brandify Web Design reserves the right to modify or discontinue services at any time. If the Client engages third-party affiliates recommended by Brandify Web Design, Brandify is not responsible for third-party services or outcomes.
The Client grants Brandify Web Design and its partners all necessary rights to use Client-provided content solely for project execution. Brandify Web Design is not responsible for archiving or returning submitted materials.
The Client confirms that all content provided does not infringe on any copyrights or trademarks and agrees to indemnify Brandify Web Design against any claims arising from provided materials.
All projects are governed by a formal written contract, which must be signed before work begins. The contract forms part of this Agreement.
Client Duties Policy
The Client is responsible for:
Providing accurate and timely content
Responding promptly to project requests
Ensuring legal ownership of all submitted materials
Maintaining communication and payment obligations
Acting professionally and ethically at all times
Failure to respond for more than 60 days may result in project abandonment without refund.
Business Hours & Communication
Brandify Web Design operates Monday–Friday, 8:00 AM to 5:00 PM (excluding holidays). Responses are typically provided within 24–48 business hours.
Website Content Policy
Brandify Web Design reserves the right to suspend or terminate services for content that is illegal, unethical, abusive, obscene, defamatory, or harmful. No refunds will be issued in such cases.
Preliminary Design & Revisions
All preliminary designs remain the property of Brandify Web Design. Revisions beyond the agreed scope may incur additional fees.
Fees & Payments
All services are prepaid
Payments are processed via credit card only
No refunds are issued for completed or ongoing work
Late or failed payments may result in suspension or termination of services
Hosting Policy
Brandify Web Design provides managed hosting services under separate agreement terms. Hosting accounts may be suspended for non-payment, prohibited content, or policy violations.
Project Cancellation Policy
Cancellation fees apply based on the contract timeline:
Within 15 days: setup fees non-refundable
After 15 days: cancellation fees may equal up to one year of service
Subscription renews automatically unless canceled in writing 30 days prior
Legal Provisions
These Terms are governed by the laws of the State of Texas, USA. The Client agrees to indemnify and hold Brandify Web Design harmless from all claims arising from violations of these Terms.
Consent
By using the Brandify Web Design website, you consent to these Terms & Conditions. Brandify Web Design reserves the right to update these terms at any time.
